A Resolution by Robert Socha
The following is a resolution I am asking my fellow city councilmen and women to adopt in defiance of totalitarianism. I am publishing it to encourage and exhort communities across the country to join in this rebuke of the federal and state governments overreach as a response to the Covid-19 strain of the coronavirus. I welcome and encourage all public servants and elected officials to adopt similar measures. I encourage civil debate concerning the contents therein and welcome the possibility of amending the resolution based on fuller consideration or newer information.
I wish to thank Effingham County (1), Illinois, Hillsdale County (2), Michigan, and the website, sanctuarycounties.com (3), for their publishing resolutions protecting 2ndAmendment Rights which I adopted and integrated into the language of this resolution.

RESOLUTION
of the
CITY COUNCIL OF THE CITY OF HILLSDALE, MICHIGAN.
RESOLUTION opposing the passage and enforcement of any trailer bill, or any bill, or any executive order, or any departmental order, or any other order, mandate, or law which infringes on the general Rights of Life, Liberty, and Property, ordained by God and enumerated in the United States Constitution and the Constitution of the State of Michigan;
WHEREAS, the First Amendment to the United States Constitution and Article 1 Section 3, 4, and 5 of the Constitution of the State of Michigan, declare the Right of the people to peacefully assemble, Worship, speak and write freely, so long as they do not infringe on the Life, Liberty, or Property of another and;
WHEREAS, the Second Amendment to the United States Constitution and Article 1 Section 6 of the Constitution of the State of Michigan, declare the Right of the people to keep and bear arms, and;
WHEREAS, the Fourth Amendment to the United States Constitution and Article 1 Section 11 of the Constitution of the State of Michigan, declare the Right of the people to be secure in their person and effects, physical and electronic, and;
WHEREAS, the Ninth Amendment to the United States Constitution and Article 1 Section 23 of the Constitution of the State of Michigan, declare that Rights not specifically enumerated “shall not be construed to deny or disparage others retained by the people,” and;
WHEREAS, the Tenth Amendment to the United States Constitution and Article 1 Section 1 of the Constitution of the State of Michigan, declare that the People retain the power not delegated by the same, and;
WHEREAS, the Fourteenth Amendment to the United States Constitution and Article 1 Section 2 of the Constitution of the State of Michigan, declare equal protection of the laws, and;
WHEREAS, the Michigan House of Representatives and the Michigan Senate, being elected by the People of the State of Michigan and being duly sworn by their Oath of Office to uphold the United States Constitution and the Constitution of the State of Michigan, and;
WHEREAS, the Governor of the State of Michigan, being elected to represent the People of the State of Michigan and being duly sworn by their Oath of Office to uphold the United States Constitution and the Constitution of the State of Michigan, and;
WHEREAS, the United States House of Representatives and the United States Senate, being elected by the people of the certain States and being duly sworn by their Oath of Office to uphold the United States Constitution, and;
WHEREAS, the President of the United States of America, being elected to represent the People of these United States and being duly sworn by their Oath of Office to uphold the United States Constitution, and;
WHEREAS, the Governor of the State of Michigan (4) and the Michigan Department of Health and Human Services (MDHHS) have manipulated the law to impose draconian lockdowns and tyrannical mandates shutting businesses, restricting indoor gatherings and religious services, restricting travel, and requiring masks, without the consent of the Legislature of the State of Michigan, and thereby without the consent of the governed, since the first restriction imposed by Governor Whitmer on March 13, 2020, expanding to a statewide lockdown for “at least three weeks” on March 23, 2020, with multiple iterations and extensions to the present day, February 23, 2021, and for the foreseeable future, and;
WHEREAS, the President of the United States issued executive orders (5a, 5b) on January 20-21, 2021, mandating masks in all Federal buildings and Transportation Centers and modes of travel, and;
WHEREAS, the United States National Institute of Allergy and Infectious Diseases Director, Dr. Anthony Fauci, an unelected official, making policy and increasing his rhetoric on mandating possibly into 2022, not only the wearing of one mask, but maybe two (6), instead of suggesting the public wear one as they determine is necessary for personal health, and;
WHEREAS, the efficacy of masks being disputed within the scientific community (7), and Dr. Fauci’s contradictory orders and findings (8), including but not limited to a 2008 study (9) into the Spanish Influenza epidemic of 1918 which surmised the wearing of masks increased the possibility of pneumonia that exacerbated the death rate, and himself not submitting to the requirements (10) over the past year, and;
WHEREAS, the rhetoric concerning the necessity of a multi-dose Covid vaccination without said vaccination having been vetted as new drugs traditionally administered (11), suggests a coming requirement for the same, without the wide scale release and information campaign of vaccine long-term trial information and with the declaration of more research being needed (12), without the understanding and promotion of possible side effects (13), without publically promoting documented evidence of the vaccine’s long-term effectiveness (14), without a declaration of secondary effects, without publically documented contraindications, and with notable severe reactions, including but not limited to premature death (15), after the inoculation of said Covid Vaccines, and;
WHEREAS, the Congress of the United States, looking to pass H.R. 5 (16), known as the “Equality Act,” which, in the name of “Equality,” appears to grant special rights and immunities to people of the “Lesbian, gay, bisexual, transgender, and queer (referred to as “LGBTQ”)” community while prohibiting the constitutionally protected Right of the free exercise of Religion, and;
WHEREAS, proposed legislation and executive orders, any bills, orders or mandates similar to, or under consideration by the Michigan State Legislature or the Congress of the United States, or the Governor of the State of Michigan, or the President of the United States, or any department therein, that would infringe the People’s Right to Keep and Bear Arms and would ban or restrict the possession and use of firearms, magazines, body armor now employed by individual citizens of Hillsdale, Michigan, for the defense of Life, Liberty, and Property within Hillsdale, Michigan;
NOW, THEREFORE, IT IS HEREBY RESOLVED, the People of Hillsdale, Michigan, do hereby oppose the enactment of any legislation, executive order, mandate, or declaration that would infringe upon the Right of the People to be safe and secure in their persons and effects, in their Right to Life, Liberty and Property, in their Right to Keep and Bear Arms, in their Right to Peaceably Assemble, in their Right to Worship and exercise Religion, in their Freedom to Travel, and;
BE IT FURTHER RESOLVED, that the People of Hillsdale, Michigan, join in agreement and solidarity with the County of Hillsdale, Michigan’s passing of a resolution (17) on February 25, 2020, “reaffirming their oath of office, the Second Amendment and Article 1 Section 6 of the Michigan Constitution,” and;
BE IT FURTHER RESOLVED, that the People of Hillsdale Michigan, join in agreement and solidarity with (18) “2020 Michigan House Resolution 227: To reaffirm the right of Michigan residents to keep and bear arms under the Constitution of the State of Michigan 1963 and the Constitution of the United States,” and;
BE IT FURTHER RESOLVED, that the Hillsdale City Council, reaffirming our oath of office, demands that the Michigan General Assembly and the Congress of the United States, the Governor of the State of Michigan and the President of the United States, and the executive and extension offices and directors, cease and desist actions restricting the Right of the People, to conduct business, to travel freely, to freely exercise their Right to self-determination, to Worship according to the dictates of their conscience, to mandate and not recommend response and requirements to Covid-19 and future infectious disease and conditions, and;
BE IT FURTHER RESOLVED, that if the Government of the State of Michigan, or the Government of the United States, or any office or department or appointee therein, shall infringe upon the inalienable Rights granted by the 27 Amendments to the United States Constitution and Article 1 of the Constitution of the State of Michigan, the city of Hillsdale, Michigan, shall become a “sanctuary city” for all unconstitutionally prohibited commerce, labor, business, travel, firearms, magazines, body armor, and unconstitutionally mandated mask mandates and medical choice freedom requirements, and the City of Hillsdale will prohibit its offices, departments and employees from funding and enforcing the unconstitutional actions of the State and Federal Government and will encourage general resistance to State and Federal enforcement of the same, and;
BE IT FURTHER RESOLVED, that this resolution is not absolute and allows for Rights not delineated herein to be retained by the People.
