My Suggestion To Donald Trump

I think Donald Trump should say, that if elected he would nominate Ted Cruz to replace Justice Scalia. I think this is a golden opportunity for him to really turn this campaign on its ear. He should tell the voters that political campaigns are not necessarily by definition a zero sum game, but they are contests that often bring the raw emotion of the political combatants to the surface. He should say that is what has been witnessed between he and Ted Cruz.

He should say that even though at times tempers flare and antagonisms that the public at large is not aware of, can often act like pebbles in your shoe, he has the greatest respect for Cruz’s ability. And if elected president, one of his first acts would be to nominate Ted Cruz to fill Justice Scalia’s empty seat.

Then he should resign himself to a more tempered approach where he responds to Cruz by saying “Ted, I have great respect for you but you are not being honest.”

We need leadership; and less than 48 hours after the passing of Justice Scalia was announced, Senate Judiciary Committee Chairman Chuck Grassley and his band of feckless craven Republicans were openly signaling they were going to squat or bend (take your pick) and make sure Obama is able to fill Scalia’s seat as soon as possible.

This isn’t ipse dixit that is exactly what they are saying. Harry Reid wasted no time in saying the Republicans would (in fact) allow the seat to be filled. Grassley, et al are listing fear of being called names as their reason for genuflecting before Obama as if he is the grand vizier, rather than a president who is to be kept in check by Congress and the SCOTUS.

If Trump, as the sycophant pundits of the Republican establishment claim, is tapping into the anger of We the People, then I submit that if he were to heed my advice he would explode upward even more in the polls.

The Republican establishment is right, We the People are angry, and them lifting their skirts as they run to oblige Obama is a large part of the reason.

Trump could point out what many others and I fully recognize. Cruz is an incomparable lawyer who has argued before the Supreme Court. His bona fides as a Constructionist jurist are without spot or blemish. He is young and could very easily spend 40 years or more on the SCOTUS.

Also in so doing it would send a clear message to the South that Trump is not what the establishment is saying about him. Trump could point to Grover Norquist’s carefully orchestrated plan to get Republican judges appointed as the reason we are now stuck with Chief Justice Roberts who on two occasions left us saddled with obamacare.

Anyone who thinks Marco Rubio, Jeb Bush, or John Kasich would be anything other than more of the same is sadly not paying close attention. We have an opportunity to break the stranglehold the Republican establishment vis-a`-vis Karl Rove, Reince Priebus, and other shadowy figures have on our Party. We have an opportunity to extricate ourselves from the treachery and capitulation we have witnessed for the last three terms.

There is no scenario I see that any of the other candidates would nominate Ted Cruz to the High Court. But with him there he would be a near clone of Antonin Scalia.

Trump would be making a profound statement pursuant to what his administration would be like. It would signal well ahead of time that he was prepared to fight for solid Constructionists to be on the Court. He would signal that he was going to bring up a Harriet Miers type and claim that person to be the most qualified. Then turn around and send Justice Samuel Alito to the Court as if he were second best to Miers.

Trump would be signaling that he was starting out with the best and going up from there.

Senate Republicans are trusting Obama when he says his pick would be “indisputably qualified.” What does that mean? In the dogma of Obama “indisputably qualified” means anti-Second Amendment, pro-abortion, and anti-separation of powers and that is just for starters.

As I said Trump has an opportunity to make a huge impact. If he is serious, then I hope he is listening.
